Donation Policy

1. Introduction
This Donation Policy outlines the principles, procedures, and legal compliance measures followed by the ICanCaRe Foundation (formerly known as I Can Win Foundation), a registered not-for-profit trust in India, for the acceptance, usage, acknowledgment, and reporting of donations received from individuals, corporates, institutions, and domestic contributors.
2. Legal Status of the Foundation
- I Can Win Foundation is registered under the Indian Trusts Act.
- It holds a valid PAN, 12A registration, and 80G certification under the Income Tax Act, 1961.
- The Foundation is not currently registered under FCRA and therefore does not accept foreign contributions directly. Contributions from outside India are accepted only through compliant Indian partner institutions or platforms approved under Indian laws.
3. Purpose of Donations
All donations will be used strictly for:
- Cancer and tobacco awareness programs
- Oral and breast cancer screening and treatment

4. Types of Donations Accepted
- One-time and recurring individual donations (via cheque, bank transfer, UPI, online platforms)
- Corporate Social Responsibility (CSR) donations under Section 135 of the Companies Act, 2013
- In-kind donations, subject to prior approval and usability
5. Modes of Donation
- Donations are accepted via cheque, bank transfer (NEFT/RTGS), UPI, online payment gateway, and approved donation platforms.
- Cash donations above ₹2,000 are not accepted in compliance with Section 80G rules under the Income Tax Act.
6. Acceptance Criteria
The Foundation reserves the right to:
- Decline any donation that may compromise its integrity, independence, or core mission
- Conduct due diligence on donors, especially for large, anonymous, or high-risk contributions
7. Conflict of Interest
Donations will not be accepted from any source that may pose a conflict of interest or influence the Foundation’s programs, decision-making, or independence.
8. Tax Benefits and Receipts
- Donors within India are eligible for 80G tax exemptions.
- Acknowledgment receipts will be issued within 7 working days of donation.
- Annual consolidated receipts can be provided on request.
9. Financial Accountability
- All donations are accounted for transparently in accordance with the Indian Accounting Standards for NGOs.
- Audited financial statements are published annually and are available on request or through the Foundation’s website.
- Dedicated fund tracking is ensured for restricted donations.
- Major donors (₹1 lakh and above) may receive a donation utilization summary upon request.
10. Donor Privacy
- Donor data is protected under applicable Indian data protection laws.
- Information is not shared with third parties without consent, except as required by law.
11. Refund Policy
- Donations once made are non-refundable, except in case of verified technical errors.
12. Dispute Resolution
- All disputes are subject to the jurisdiction of courts in Faridabad, Haryana, India.
13. Governing Framework
This policy is governed by the relevant provisions of:
- The Income Tax Act, 1961
- The Companies Act, 2013 (CSR provisions)
- Indian Trusts Act / Societies Act / Companies Act (as applicable)
14. Amendment Clause
This policy may be amended or updated from time to time with the approval of the Board of Trustees, in compliance with changes in applicable laws or operational requirements.
